Terms and conditions of purchase

1. Ownership
The goods remain the property of the Seller until the full purchase price is paid by the Buyer. Ownership is transferred only after the full amount has been credited to the Seller's account.

2. Buyer's Declaration
The Buyer declares that:

  1. has become familiar with the technical condition of the tank and accepts its used nature,
  2. has been informed of any defects revealed by the Seller before sale,
  3. is purchasing the goods "as is," taking into account normal wear and tear resulting from use.

3. Seller's Warranty and Liability

  1. The standard warranty period is 12 months from the date of delivery.
  2. If the Seller conceals a defect, intentionally or through gross negligence, the warranty period is 24 months from the date of delivery.
  3. The warranty covers only hidden defects that prevent the tank from being used properly for its intended purpose.

4. Scope of Liability

  1. If a defect is discovered during the warranty period, the Seller – after prior consultation with the Buyer – may repair the defect or replace the tank with another, functional unit.
  2. The Seller is not responsible for the costs of dismantling, transporting, installing, or connecting/disconnecting the tank to the system.
  3. The Seller is not responsible for lost profits or indirect damages resulting from a defect in the goods.

5. Warranty Exclusions
The Seller is not liable for defects resulting from:

  • mechanical damage occurring after delivery (falls, impacts, dents, scratches, cracks),
  • exposure to moisture or flooding leading to damage to equipment components (engines, gear motors, mixers, probes),
  • unauthorized repairs or modifications without the Seller's consent,
  • improper use contrary to the intended use, the user manual, or the manufacturer's recommendations,
  • defects about which the Buyer knew or could have known before purchase,
  • lack of proof of purchase (invoice, receipt, or other proof).

6. Warranty Period Begins
The warranty period begins on the date of actual delivery of the tank. In the event of a delay in acceptance due to the Buyer's fault, the warranty period begins on the date of acceptance.

7. Warranty Limitations
The warranty does not cover:

  • consumables, materials subject to normal wear and tear,
  • damage resulting from normal wear and tear or negligence,
  • defects that do not prevent the proper use of the tank for its intended purpose.

8. Conclusion of the Contract and Acceptance of Terms and Conditions
The Contract is deemed concluded and these Terms and Conditions of Sale are deemed fully accepted by the Buyer when, after receiving the offer from the Seller:

  1. sends a return email confirming acceptance of the offer,
  2. or confirms acceptance of the offer by telephone,
  3. or makes a deposit payment or the full purchase price payment to the bank account indicated by the Seller.

The Buyer's payment (in part or in full) constitutes acceptance of all provisions of these Terms and Conditions of Sale and acknowledges that they have become familiar with the technical condition of the goods described in the offer.

9. Custom Orders and Cancellation Costs

  1. If an order is placed for goods that require customization (alterations, modifications) to the Buyer's specifications, and the Buyer subsequently cancels the contract after the Seller has commenced such work, the Buyer is obligated to cover all documented costs incurred by the Seller in connection with such work.
  2. The costs referred to above include, in particular, the costs of labor, materials, and other resources used to customize the goods.
  3. The Seller has the right to deduct the amount due from the advance payment made by the Buyer. If the costs incurred exceed the value of the advance payment, the Buyer is obligated to pay the remaining amount within 7 days of receiving the debit note.

10. Final Provisions

  1. Any disputes arising in connection with the contract shall be resolved by the court having jurisdiction over the Seller's registered office.
  2. If any provision of these Terms of Sale proves invalid or contrary to mandatory provisions of law, this shall not affect the validity of the remaining provisions. The relevant provisions of Polish law shall apply in place of the invalid provision.
  3. These General Terms of Sale constitute an integral part of the contract. The Parties exclude the application of any standard contracts (including general terms and conditions of purchase) used by the Buyer.
  4. These Terms of Sale apply only to contracts concluded with entities that are not consumers within the meaning of Article 22¹ of the Civil Code (B2B transactions).
